§1. General Provisions
- These Terms and Conditions define the rules for using the ArtRate.art website (hereinafter: the “Service”).
- The Service provides analytical services consisting of independent market analysis of artworks, antiques, and collectible objects.
- Use of the Service constitutes acceptance of these Terms and Conditions.
§2. Nature of the Service and Valuation Status
- Services provided via the Service consist of an independent market analysis of objects, based on information, photographs, and documents submitted by the User.
- The valuation constitutes an indicative market opinion and does not constitute a court expert opinion, certified appraisal, or formal valuation within the meaning of applicable law.
- The valuation is non-binding and does not guarantee the achievement of any specific price in a future transaction.
- The valuation is prepared according to the state of knowledge and market conditions as of the date of its preparation.
§3. Scope and Use of the Valuation
- The valuation prepared by the Service may be used in particular for: obtaining an indicative market value of an object, supporting purchase or sale decisions, assessing the advisability of commissioning further specialist expertise, and managing a private collection or portfolio of objects.
- The valuation is not intended for court, tax, administrative, or insurance purposes.
§4. Analysis Methodology and Standard of Care
- The market analysis performed by the Service is based on available auction data, private sales information, observation of market trends, and expert knowledge.
- Services are provided with reasonable professional care, in accordance with current knowledge and market practice.
- The scope and level of detail of the analysis depend on the quality and completeness of the materials submitted by the User.
§5. Data Provided by the User
- The valuation is based solely on the data, materials, and documents provided by the User.
- The Service shall not be liable for consequences resulting from: incomplete, inaccurate, or misleading data; failure to disclose defects, conservation interventions, or modifications of the object; or lack of authenticity of the object.
§6. No Guarantee of Market Outcome
- The Service does not guarantee the sale of the object or the achievement of the value indicated in the valuation.
- Market values may change over time and depend on numerous factors beyond the control of the Service.
§7. Liability of the Service
- The Service shall not be liable for: investment, purchase, or sale decisions made by the User; the results of transactions concluded based on the valuation; acts or omissions of third parties, including auction houses, galleries, intermediaries, or buyers; or changes in market conditions after the date the valuation was prepared.
- In any case, the Service’s liability shall be limited to the amount paid by the User for the relevant service.
§8. Valuation Report and Copyright
- The valuation report provided to the User constitutes a work protected by copyright law.
- The report is intended solely for the User’s personal use.
- Any further distribution, resale, or commercial use requires the prior written consent of the Service.
§9. Right of Withdrawal
- A User who is a consumer has the right to withdraw from the contract within 14 days, unless the User has expressly consented to the commencement of the service before the expiry of this period and has been informed of the loss of the right of withdrawal.
- Upon commencement of the service, the right of withdrawal shall expire.
§10. Complaints
- Complaints regarding services provided by the Service may be submitted electronically to the Service’s contact email address.
- Complaints shall be reviewed within 14 days of receipt.
§11. Governing Law
- These Terms and Conditions shall be governed by the law of England and Wales.
- The provisions of these Terms and Conditions do not exclude or limit consumer rights granted under mandatory provisions of the law of the country of the consumer’s habitual residence.
